Termination does not waive outstanding obligations owed by either party.

10. Use of WhatsApp Official API & RCS

C S ENTERPRISE may communicate with users through WhatsApp Business Platform, Meta Business Messaging Services, and Rich Communication Services (RCS).

By providing your contact details and opting into communications, you acknowledge and consent to receiving:

  • Transactional messages
  • Customer service communications
  • Account notifications
  • Order confirmations
  • Service updates
  • Promotional communications where legally permitted

Users agree not to:

  • Abuse messaging services
  • Use communications for unlawful purposes
  • Attempt unauthorized access to messaging systems

All WhatsApp and RCS communications shall remain subject to Meta policies, Google RCS policies, telecom regulations, and applicable Indian laws.

11. Message Delivery & Compliance Policy

C S ENTERPRISE strives to ensure timely message delivery; however, delivery depends upon factors outside our control including:

  • Mobile network availability
  • Device compatibility
  • Telecom operator restrictions
  • Internet connectivity
  • Third-party platform performance

We do not guarantee:

  • Instant delivery
  • Continuous availability
  • Error-free transmission
  • Uninterrupted service

Users agree that messaging services shall be used only in compliance with applicable anti-spam laws and platform policies.

The Company reserves the right to suspend messaging access where misuse, abuse, spam, fraud, or regulatory violations are detected.

12. Intellectual Property Rights

All intellectual property associated with C S ENTERPRISE including:

  • Logos
  • Trademarks
  • Brand names
  • Designs
  • Graphics
  • Website content
  • Software
  • Documentation

remain the exclusive property of C S ENTERPRISE or its licensors.

Nothing in these Terms grants ownership rights to users.

Users may not:

  • Reproduce
  • Copy
  • Modify
  • Distribute
  • Reverse engineer
  • Commercially exploit

any content without prior written permission.

13. Confidentiality

Any confidential information exchanged between users and C S ENTERPRISE shall be treated with reasonable care.

Users agree not to disclose confidential information obtained through use of our services without authorization.

Confidentiality obligations shall survive termination of these Terms where legally permissible.

14. Disclaimer of Warranties

Services are provided on an “as-is” and “as-available” basis.

To the fullest extent permitted under law, C S ENTERPRISE disclaims all warranties including:

  • Accuracy
  • Reliability
  • Availability

We do not guarantee that services will always be secure, uninterrupted, error-free, or free from harmful components.

Users utilize services at their own risk.

15. Limitation of Liability

To the maximum extent permitted by law, C S ENTERPRISE shall not be liable for:

arising from use of our services.

Where liability cannot legally be excluded, our total aggregate liability shall not exceed the amount actually paid by the user to C S ENTERPRISE during the preceding twelve months.

16. Indemnification

You agree to defend, indemnify, and hold harmless C S ENTERPRISE, its directors, employees, affiliates, agents, representatives, and service providers from any claims, liabilities, damages, losses, costs, penalties, or expenses arising from:

This indemnification obligation survives termination of the agreement.

17. Governing Law (India)

These Terms shall be governed and interpreted in accordance with the laws of India.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

Before initiating formal proceedings, parties shall make reasonable efforts to resolve disputes amicably through negotiation.

Continued use of services following publication of revised Terms constitutes acceptance of the updated Terms.
